This Privacy Policy describes the online data collection and usage practices that apply to all USFN sites - usfn.org (the “Site”) and usfnsource.org - operated by USFN (“we”). It does not apply to information collected in any other manner. It is USFN’s general policy to collect and store only the personal information that members, customers, and visitors knowingly provide, together with the limited technical information described below. Visitors to the public areas of the Site may browse anonymously.
1. Information We Collect
When you use the Site, we may ask you to provide personal information such as your name, mailing address, email address, telephone number, and general background information, for example when you register, join, renew, sign up for an event, or contact us. We also automatically collect certain technical information about your device and your use of the Site, which may include your IP address, browser type, domain name, access times, the referring website, the pages you visit, any search terms you enter, and similar web-usage data. This technical information is used to help identify trends and administer the Site and is not linked to your personal information except as described below.
2. How We Use Your Information
We use the information we collect, whether personal, demographic, or technical, to operate and improve the Site, to foster a positive user experience, and to deliver the products, services, publications, events, and membership benefits we offer. We may use your contact information to send you email and other communications about USFN updates, programs, and offerings; the nature and frequency of these messages will vary. We may use analytics tools such as Google Analytics and similar services to understand and improve how the Site is used. We also use information for internal system administration, to diagnose server problems, and to compile aggregate demographic information such as country of origin and internet service provider. We may link technical information with your personal information for these purposes.
3. How We Share Your Information
We do not sell your personal information. USFN makes member contact information available through the USFN Membership Directory using its Web site and to those who register for its conferences. In addition, USFN incorporates information users provide into the Membership Directory that it provides for distribution at hosted events and industry events. We do not disclose your personal information, combined personal and demographic information, or information about your use of the Site to third parties except as follows. We may share information with companies and individuals we engage to perform functions on our behalf, such as hosting, data analysis, marketing assistance, and customer service; these service providers may access personal information only as necessary to perform their functions and may not share it with any other party. We may also share information with companies, organizations, or individuals outside USFN if we have a good-faith belief that access, use, preservation, or disclosure is reasonably necessary to (1) comply with any applicable law, regulation, legal process, or enforceable governmental request; (2) enforce these policies, including investigation of potential violations; (3) detect, prevent, or address fraud or security or technical issues; or (4) protect against harm to the rights, property, or safety of USFN, our users, or the public, as required or permitted by law.
4. Cookies, Web Beacons, and Local Storage
The Site may use cookies, local storage, and electronic images known as web beacons (sometimes called single-pixel gifs) to count visitors and compile aggregate statistics about Site usage. Web beacons collect a limited set of information, such as a cookie number, the time and date of a page view, and a description of the page. Web beacons cannot be declined individually, but they can be rendered ineffective by declining all cookies or by setting your browser to notify you each time a cookie is offered so that you can accept or decline it.
5. Your Choices: Access, Correction, and Opt-Out
We aim to give account holders reasonable access to their personal information and the ability to update or correct it. If your information is incorrect, we will provide ways to update or delete it unless we must retain it for legitimate business or legal purposes. We may ask you to verify your identity before acting on a request. If you receive newsletters, commercial emails, or other communications from USFN and later change your mind, you may opt out using the unsubscribe link in those messages or by contacting us at communication@usfn.org. If we use Google Analytics, you may also use the Google Analytics opt-out tools available from Google. We may retain information we collect in order to make your future use of the Site more efficient and relevant, except where deletion is requested or required.
6. Security
We have implemented commercially reasonable technical and organizational measures designed to protect your personal information from accidental loss and from unauthorized access, use, alteration, or disclosure. However, we cannot guarantee that these measures will never be defeated. We restrict access to personal information to USFN employees, organization leadership, contractors, and agents who need it to perform their work and who are subject to confidentiality obligations.

Welcome to usfn.org and usfnsource.org, the websites of USFN, America’s Mortgage Banking Attorneys (“USFN,” “we,” “us,” or “our”). 2. Intellectual Property and Use of Site Content
The contents of the Site, including text, graphics, images, logos, button icons, software, publications, and other materials (collectively, “USFN Content”), are owned by USFN or its content suppliers and are protected by United States and foreign copyright, trademark, and other intellectual property laws. USFN is committed to full compliance with all applicable antitrust and competition laws. Your use of the Site, including any discussion forums, member communities, comment features, or other interactive areas, is subject to the USFN Antitrust Statement, which is incorporated into these Terms by reference and which appears separately on the Site.
5. Sponsor and Advertiser Content
If you participate as a sponsor or advertiser, you are solely responsible for all content you submit to USFN or provide for display on the Site, including artwork, text, images, graphics, logos, data, URLs, and links (collectively, “Ads”). You may be required to accept additional written terms governing your sponsorship or advertising. USFN does not represent or guarantee the accuracy or reliability of sponsor or advertiser content, disclaims all liability relating to your Ads, and you agree to indemnify USFN for any losses arising from your Ads. By submitting Ads for display in any public area of the Site, you grant USFN a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, display, and distribute the Ads for the purpose of providing and promoting the sponsorship or advertising you have arranged.
6. Links to Third-Party Sites and Social Media
The Site may contain links to third-party websites, content, and social media, including testimonials. These links are provided solely as a convenience and do not constitute an endorsement by USFN. You agree to defend, indemnify, and hold harmless USFN, its affiliates, and their respective officers, directors, employees, and agents from any claims, actions, or demands, including reasonable legal and accounting fees, arising from (i) any content or material you provide to the Site, or (ii) your breach of these Terms. USFN will promptly notify you of any such claim.
10. Governing Law and Dispute Resolution
These Terms and the relationship between you and USFN are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. You agree that any action arising under these Terms will be brought exclusively in the state or federal courts located in Tarrant County, Texas, and you consent to the personal and exclusive jurisdiction of those courts.

USFN Antitrust Statement

USFN is a not-for-profit association whose members and participants include law firms and other professionals who may compete with one another. USFN is firmly committed to full compliance with all federal and state antitrust and competition laws, and it expects the same commitment from its members, staff, volunteers, sponsors, and everyone who participates in USFN activities or uses USFN’s website, publications, events, and online communities.
The antitrust laws prohibit agreements and conduct that unreasonably restrain competition. An antitrust violation does not require a formal written agreement. A discussion of a sensitive topic followed by parallel action by those involved may be enough to create liability. Violations of the antitrust laws can carry severe consequences for USFN, for individual companies, and for the individuals involved, including substantial civil damages and, under the Sherman Act, criminal penalties.
If a sensitive topic arises in any USFN setting, you should object, ask that the discussion stop, and, if it continues, leave and report the matter to USFN leadership. Participation in USFN activities and use of USFN’s website constitute agreement to abide by this statement. This statement is a general guide and is not a substitute for advice from your own legal counsel on specific antitrust questions.
