New Tools for Lien Resolution in Delaware

Delaware has amended its statute on attorney satisfactions of liens. Previously only available to satisfy mortgages, the amended statute provides that a licensed Delaware attorney may now satisfy a homeowner association lien, condominium lien, UCC financing statement, judgment or any other monetary lien recorded with a recorder of deeds office, upon paying the lien in full. The statute also provides for a partial release of lien. This will enable Delaware attorneys to clear title in multiple instances by filing an affidavit as provided in Title 25, Section 2120 of the Delaware Code.
